Confirmation of the child's place of residence: updated procedure

On August 22, 2018, the Cabinet of Ministers accepted Resolution No. 620, which changed the procedure for the bodies of caretaking activities related to the protection of the rights of the child.

The updated order specifies that for the confirmation of the child's place of residence (in particular, to resolve the issue of his temporary stay abroad), the parent with whom the child lives, must submit the following documents to the children's service office (at the place of residence of the child):

- a statement;

- a copy of passport;

- a copy of the child's passport (if available);

- a certificate of registration of place of residence (in the absence of such data in the passport);

- certificate of registration of the child's place of residence;

- a copy of the birth certificate of the child;

- a copy of the court decision on the dissolution of the marriage (if there is any);

- confirmation of the sending of the recommended letter (if there is any);

- a copy of the opinion of the medical advisory committee (in the case of a serious illness of a child).

In the future, the relevant child service after the examination of documents, visiting the child at the place of residence, holding a conversation with another parent or with the child (if he is 14 years old) prepares a conclusion on confirmation of the child's place of residence for her temporary departure outside Ukraine.

The Service may refuse to issue a conclusion in the following cases:

- the applicant did not submit all documents;

- there is a court decision that defines a different place of residence of the child;

- open proceedings concerning the determination of the place of residence of the child.

On the day the decision is made, the Service must notify the applicant (by telephone) and the other parent (by registered letter).

After the decision is made, there is only 10 days for an appeal. Otherwise, the desicion becomes legally valid and its certified copy is issued to the applicant for presentation at the time of crossing the state border of Ukraine.

Note that Decree No. 620 ("On Amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 866 dated September 24, 2008) will come into force on August 28, 2018.
