Business got simplified customs procedures

The President Poroshenko signed the Law on the introduction of a "single window".

The relevant Law "On Amendments to the Customs Code of Ukraine and some other laws of Ukraine regarding the implementation of the "single window" mechanism and the optimization of the implementation of control procedures for the movement of goods across the customs border of Ukraine" was adopted on July 5, but President Poroshenko returned it to the Verkhovna Rada with edits.

The head of the state, in particular, proposed to exclude certain provisions of the Law, according to which special wagons for transportation of grain are classified into machinery and equipment for the agro-industrial complex, for the purchase of which agricultural producers are provided with state support. According to the President, this item is unfair to most agricultural producers, since predominantly large agricultural enterprises will qualify for such state support.

On September 6, the Verkhovna Rada adopted the Law, taking into account the edits of the President.

In general, the adopted law creates better business conditions for foreign economic activity, reduces the time for export-import operations and improves the investment attractiveness of Ukraine.

Thus, the Law amended the Customs Code, according to which, for cooperation between the declarants and the customs authorities, it is proposed to use the single state information information portal "The Single Window for International Trade".

It also provides a reduction in the number of border control authorities at the expense of assigning responsibility for checking permit documents - to customs officials, and for radioactive contamination of vehicles and cargoes - to officials of the State Border Guard Service (now these functions are performed by officials of the State Inspection).

In addition, sanitary and epidemiological control of goods transiting through the customs border will be carried out in the customs territory only after customs clearance of goods. It should be noted that such control until recently was reduced to obtaining a "conclusion" - a permissive document issued on the basis of the application with the attached documents and in no way testified to a real verification of a particular product (for a period of validity of up to 5 years).

For reference: in August 2016, the Government made the first step towards the introduction of a "one-stop shop", but the functioning and development of this mechanism was virtually impossible due to the lack of necessary legislative changes. Thus, according to the Analytical Report "Simplification of Trade Procedures in Ukraine: Business Estimates and Expectations - 2017" prepared by the Institute for Economic Research and Policy Consulting, only half of the enterprises reported on having experience in customs formalities using this principle. There was a widespread practice of providing documents simultaneously in paper and electronic form through existing legislative and regulatory requirements.

From now on, due to the legislative consolidation of the "one window" mechanism, trade procedures need to be simplified and business time expenditures for the execution of goods clearance procedures should be reduced. With the new law, only customs officers and border guards will remain in the customs. They will preview the goods and in two hours decide whether to skip them or call profile experts. After the corresponding call, the experts must arrive immediately and in the same 2 hours decide to drop the goods, prohibit their pass or appoint additional inspection / processing. Information about all actions and decisions about the product will be immediately entered into the information system "single window". 

The law will come into force the next day after the day of its publication.
