Who has the right not to pay a court fee

According to Art. 5 of the Law On court fee payment the next categories are exempted of court fee during the consideration of the case in all courts:

1) plaintiffs - in cases of wage collection and renewal at work;

2) plaintiffs - in cases of compensation for damage caused by injury or other damage to health, as well as the death of an individual;

3) the plaintiffs - in cases concerning the payment of alimony, increase in their size, payment of additional expenses for a child, the imposition of a penalty (penalty) for delaying the payment of alimony, indexation of alimony or a change in the method of their recovery, as well as applicants in the case of filing an application for a court order on alimony;

4) plaintiffs - in cases concerning disputes related to compensation, return of property, or in cases involving disputes related to the reimbursement of its value to citizens rehabilitated in accordance with the Law of Ukraine "On Rehabilitation of Victims of Political Repression in Ukraine";

5) persons suffering from mental disorders, and their representatives - in cases concerning disputes related to the consideration of issues concerning the protection of the rights and legitimate interests of a person during the provision of psychiatric care;

6) plaintiffs - in cases on compensation for material damage caused as a result of a criminal offense;

7) citizens who, in cases stipulated by law, file applications to the court to protect the rights and interests of other persons;

8) persons with disabilities due to the Second World War and the family of soldiers (guerrillas) who perished or have disappeared, and the person who is equal to them in accordance with the established procedure;

9) persons with disabilities of groups I and II, legal representatives of children with disabilities and incapacitated persons with disabilities;

10) plaintiffs - citizens belonging to categories 1 and 2 of the victims of the Chornobyl catastrophe;

11) voters - in matters concerning clarification of the list of voters;

12) servicemen, servicemen and reservists who are called up for training (or check-ups) and special meetings - in matters related to the performance of a military duty, as well as during the performance of official duties;

13) participants in hostilities, victims of the Revolution of Welfare, Heroes of Ukraine - in cases related to violation of their rights;

14) plaintiffs - in cases in accordance with the procedure established by Article 12 of the Law of Ukraine "On Refugees and Persons in Need of Additional or Temporary Protection";

15) individuals (except for business entities) - creditors who apply for monetary claims to the debtor on payment of arrears of wages, obligations as a result of causing damage to life and health of citizens, payment of royalties and alimony, - after announcement of a bankruptcy case, as well as after notification of the bankruptcy of the debtor;

15-1) local self-government bodies - for applying for recognition of the inheritance from the dead;

16) plaintiffs - for filing claims for disputes related to the provision of the status of a participant in hostilities in accordance with Paragraphs 19, 20, Part One, Article 6 of the Law of Ukraine "On the Status of Veterans of War, Guarantees of Their Social Protection";

17) sentenced to death in the form of life imprisonment, imprisonment for a certain period and penalties not related to imprisonment, as well as persons who have been taken into custody, - in cases related to issues resolved by the court under the execution time of the sentence in accordance with Article 537 of the Criminal Procedure Code of Ukraine, in the absence of funds on their personal accounts sufficient to pay the court fee.

21) Applicants - in cases concerning applications for establishing facts of legal significance filed in connection with armed aggression, armed conflict, temporary occupation of the territory of Ukraine, emergency situations of a natural or man-made nature, which resulted in the forced resettlement from temporarily occupied territories Ukraine, death, injury, imprisonment, illegal deprivation of liberty or theft, as well as violation of the right to ownership of movable and / or immovable property;

22) plaintiffs - in cases concerning lawsuits against the aggressor state of the Russian Federation on compensation for property and / or non-pecuniary damage caused by the temporary occupation of the territory of Ukraine, armed aggression, armed conflict, which led to the forced resettlement of the temporarily occupied territories of Ukraine, death, injury, imprisonment, illegal deprivation of liberty or theft, as well as violation of the right to ownership of movable and / or immovable property;

23) plaintiffs - for filing claims for appealing against decisions of the National Commission for Rehabilitation in legal relations arising under the Law of Ukraine "On Rehabilitation of Victims of Repressions of the Communist Totalitarian Regime of 1917-1991".

At the same time, we note that according to the part. 1 item 4 of the Law "On court fee", the amount of court fee is set depending on the subsistence minimum for able-bodied persons as of January 1 of the calendar year in which the corresponding application or complaint is filed in court.
