The procedure for disclosing bank secrecy has changed

The NBU has led the procedure for keeping, protecting, using and disclosing bank secrecy in accordance with the norms of the legislation.

From now on, the state bodies defined in clauses 3, 3-1 and 3-2 of the first section of Article 62 of the Law of Ukraine "On Banks and Banking" can, upon a written request, access to information on transactions on the accounts of individuals, including information about counterparties, without a court order, even if their accounts are open with other banks.

The corresponding changes were approved by the Resolution of the National Bank No. 13 of January 31, 2020.

We would remind that on October 31, 2019, the Verkhovna Rada amended some legislative acts of Ukraine on confiscation of illegal assets of persons authorized to perform functions of the state or local self-government, and punishment for acquiring such assets.

This law amended Article 62 of the Law on Banks and Banking to simplify the procedure for the disclosure by banks of information containing banking secrecy.
